Kayaka (‘us’, ‘we’, or ‘our’) knows that privacy is important for our users (‘you’, ‘your’). We are committed to protecting and respecting the privacy of your data and to be transparent with you about the information we are collecting and what we will do with that information or data. This privacy policy applies to the Kayaka website (‘Website’ available at https://kayaka.app), the Kayaka iOS and Android mobile applications (‘Service’) and Kayaka content such as text, graphics, images, icons, information and other material (‘Content’). This page informs you of our policies regarding the collection, use and disclosure of personal data when you use our Service and the choices you have associated with that data. We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. By accessing our Website or Service, you confirm that you have read and understood the entirety of this Privacy Policy. 

 

1. Definitions

Personal Data refers to data about a living individual who can be identified from that data (or from that and other information either in our possession or likely to come into our possession).

Personal Data

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to process your registration when creating a Kayaka account, contact you, identify you or cater tailored content for you (“Personal Data”). Personal identifiable information may include, but is not limited to:

  • Email address (required to create and access your account)

  • Name (required to create an account)

  • Password (required to create and access your account)

  • Username (required to create and access your account)

  • Age of your child(ren) – Optional – it is used so that we can cater the content that is most interesting to you. This information is not visible to the rest of the Kayaka users.

  • Nickname/ alias of your child(ren) – Optional – it is used so that we can personalise your experience. This information is not visible to the rest of the Kayaka users.

  • Pictures you upload – You can upload a profile picture for your account. Also, when and if you upload an activity, you can attach pictures for that activity. All pictures will be visible to all users of the Service.

  • Cookies and Usage Data


We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us. We however reserve the right to email you to confirm transactions, to address account issues, such as when you make a purchase, or you request a reset password or as required by law.


If you sign in to or connect to our Website, Service or Content using a third-party service, we will use that service to authenticate you. We may also access, use and collect other information that you have agreed may be provided by that third party, such as your username, name and e-mail address. We collect this information so that it can be used for the purposes explained in this Privacy Policy.

 

Usage Data

We may also collect information that your browser sends whenever you visit our Service or when you access the Service by or through a mobile device (“Usage Data”).


This Usage Data may include information such as your computer’s Internet Protocol address (IP address), browser type, browser version, operating system, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.


When you access the Service with a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.


We may also collect and store information such as your browser type, IP address, language, operating system, unique device identifier, mobile network information including phone number, the date and time of your usage, the content and pages you view and the websites you visited immediately before and after visiting our Website. We may associate your device identifiers or user identifier with your Kayaka account.


We may also collect and store certain information in server logs, including in third-party logs. This may include: (i) details of how you used our Service or Content, (ii) Internet protocol address, (iii) device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL and (iv) cookies that may uniquely identify your browser or Kayaka account.


We may collect and store information (including personal information) locally on your device using mechanisms such as browser web storage (including HTML 5) and application data caches.

 

Tracking Cookies Data

We use cookies and similar tracking technologies to track the activity on our Service and we hold certain information


Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Other tracking technologies are also used such as beacons, tags and scripts to collect and track information and to improve and analyse our Service.


When you visit the Website or Service again, the cookie allows our Website or Application to recognize you. We use “persistent cookies” to save your login information for future logins to our Website. We use “session ID cookies” to better understand how you interact with our Service or Content and to monitor aggregate usage and web traffic routing. Kayaka uses the collected data for various purposes:

Kayaka will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer periods.

 

We will not retain your data for longer than is necessary to fulfill the purpose for which it is being processed. To determine the appropriate retention period, we consider the amount, nature and sensitivity of the personal data, the purposes for which we process it, and whether we can achieve those purposes through other means. We also consider the periods for which we might need to retain personal data in order to meet our legal obligations, or to deal with complaints and queries, and to protect our legal rights in the event of a claim being made.

 

When we no longer need your personal data, we will securely delete or destroy it. We will also consider if and how we can minimise over time the personal data that we use, and if we can anonymise your personal data so that it can no longer be associated with you or identify you, in which case we may use that information without further notice to you.

If you are located outside Germany and choose to provide information to us, please note that we transfer the data, including Personal Data, to Germany and process it there.

 

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

 

Kayaka will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organisation or a country unless there are adequate controls in place including the security of your data and other personal information.

Kayaka may disclose your Personal Data in the good faith belief that such action is necessary to:

  • To protect and defend the rights or property of Kayaka

  • To prevent or investigate possible wrongdoing in connection with the Service

  • To protect the personal safety of users of the Service or the public

  • Service providers and agents. We may share your information with certain third parties selected by us to help support our operations. These include, for example, services that help us process payments, analyze web traffic, send emails, and track customer service requests. We may disclose your information when we believe we have your consent to do so, such as when you contact customer service and ask us about your account, or when we have the consent of someone we believe is authorized to consent on behalf of you, such as the individual associated with the payment method for your account.

 

WE WILL NOT SELL, SHARE OR TRADE THE PERSONALLY IDENTIFIABLE INFORMATION YOU SUBMIT TO ANY UNRELATED THIRD PARTIES, MASS MARKETERS, OR TO OTHER NON-AFFILIATED ENTITIES FOR THEIR MARKETING PURPOSES WITHOUT YOUR CONSENT.

 

7. Security of Data

 

The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

 

We have implemented and maintained reasonable security practices to protect against the unauthorized access, use, modification, destruction or disclosure of your personal information. However, no method of transmission or storage is completely secure, and we therefore cannot guarantee absolute security. It is your responsibility to protect the data that resides on your mobile device and we strongly encourage you to do so, including encryption of data and use of passwords to lock your mobile device, in case it is lost or stolen.

Kayaka’s legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.

 

Kayaka may process your Personal Data because:

  • For payment processing purposes

  • To comply with the law

If you are a resident of the European Economic Area (EEA), you have certain data protection rights. Kayaka aims to take reasonable steps to allow you to correct, amend, delete or limit the use of your Personal Data.

  • The right to withdraw consent. You also have the right to withdraw your consent at any time where Kayaka relied on your consent to process your personal information.

9. Service Providers

 

We may employ third party companies and individuals to facilitate our Service (“Service Providers”), provide the Service on our behalf, perform Service-related services or assist us in analysing how our Service is used.

 

These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

 

Firebase 

Firebase is an analytics service provided by Google Inc. You may opt-out of certain Firebase features through your mobile device settings, such as your device advertising settings or by following the instructions provided by Google in their Privacy Policy.

Sentry.io

Sentry.io is an error tracking tool which collects information regarding runtime errors and crashes. Error reports are sent to Sentry.io servers, which allows developers to reproduce and fix crashes. The information is collected anonymously, is not used for personal reasons, and is subsequently deleted. This analysis helps us to continuously improve our website and fix hidden code errors. Such processing is in our legitimate interest because the data is used solely for identifying and analysis errors.

 

RevenueCat

RevenueCat is a service used to verify App Store receipts, process subscription purchases, restore previous purchases and sync purchase status between devices signed into your Apple ID. RevenueCat provides us with data on when a user first used the app and with information about purchased subscriptions. This information is linked to an anonymous App User ID. RevenueCat does not have access to any personal information. Kayaka does not send custom app user IDs or attribution information to RevenueCat.

 

10. Payments

 

We provide paid products and/or services within the Service. In that case, we use third-party services for payment processing (e.g. payment processors). We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy.

 

11. Links to Other Sites

 

Our Service may contain links to other sites that are not operated by us. If you click a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

 

12. Children’s Privacy

 

Our Service does not address anyone under the age of 18 (“Children”).

We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

 

13. Changes to This Privacy Policy
